These Terms and Conditions of Sale govern all sales of products by Fun Zone Bounce. By placing an order, Buyer agrees to these Terms.
1. Products & Scope
These Terms apply to the sale of products including, but not limited to, inflatable amusement devices, concession machines, portable toilets and sanitation equipment, games, and related accessories.
All transactions are final sales only. No rentals or leases are offered unless expressly agreed in writing.
2. Orders & Acceptance
All orders are subject to acceptance by Seller. Seller reserves the right to refuse or cancel any order. All specifications, pricing, and quantities must be confirmed in writing.
3. Pricing & Payment
Prices are subject to change without notice. Seller may require full payment prior to production or shipment. Buyer is responsible for all applicable taxes, duties, and fees.
4. Final Sale / No Returns
All sales are final. No refunds, returns, or exchanges are permitted except as required by law or expressly stated under a written warranty.
5. Shipping & Risk of Loss
Delivery dates are estimates only. Risk of loss or damage transfers to Buyer upon shipment or delivery. Buyer must inspect products upon receipt and report any visible damage or shortages within 48 hours.
6. Buyer Responsibilities & Product Use
Buyer is solely responsible for proper installation, anchoring, operation, supervision, maintenance, and compliance with all applicable laws, regulations, permits, and insurance requirements. Products may involve inherent risks if improperly used.
7. Assumption of Risk
Buyer assumes all risks related to the use, storage, transport, operation, and resale of the products, including personal injury, property damage, or equipment failure.
8. Limitation of Liability
To the fullest extent permitted by law, Seller shall not be liable for indirect, incidental, or consequential damages. Seller’s total liability shall not exceed the purchase price of the product giving rise to the claim.
9. Indemnification
Buyer agrees to defend, indemnify, and hold harmless Fun Zone Bounce from all claims, damages, losses, or expenses arising from Buyer’s use, misuse, resale, or failure to comply with safety or legal requirements.
10. Warranties
Products may include a limited manufacturer’s warranty provided separately in writing. Seller disclaims all other warranties, express or implied, including merchantability or fitness for a particular purpose.
11. Modifications
No oral statements modify these Terms. Any changes must be in writing and signed by an authorized representative of Seller.
12. Governing Law
These Terms are governed by the laws of the State/Province, without regard to conflict of law principles.
13. Severability
If any provision is found unenforceable, the remaining provisions shall remain in effect.
14. Entire Agreement
These Terms constitute the entire agreement between Buyer and Seller regarding the sale of products.
